Settlement Status

The Court has preliminarily approved the Settlement. The Court will hold a "Fairness Hearing" on July 24, 2025 at 10:00 A.M. to consider the Settlement.

If you are eligible and the Court approves the Settlement, you will receive a portion of the Net Settlement Fund on a pro rata basis. The relief provided to the Settlement Class will be provided only if the Court gives final approval to the Settlement and, if there are any appeals, after the appeals are resolved in favor of the Settlement.

What is this Settlement about?

Adam Herrell filed a lawsuit claiming that L&B Transport, LLC violated its legal duties regarding the protection of private information. The lawsuit alleges that L&B Transport, LLC was negligent and breached contractual and statutory duties in connection with a Data Incident allegedly discovered by L&B in August 2024.

The affected information varied by individual, but included names, Social Security numbers, and driver's license numbers.

L&B Transport, LLC denies that it did anything wrong and contends that no customer information was misused. The parties agreed to settle to avoid the cost and risk of continuing the case in court.

Who is included?

You are a member of the Settlement Class if:

You are a resident within the United States of America whose Private Information (which may include names, Social Security numbers, and driver's license numbers) may have been exposed to unauthorized third parties as a result of the data incident allegedly discovered by L&B Transport, LLC in August 2024.

How do I participate in the Settlement?

To receive a payment, you must submit a valid Claim Form by July 9, 2025.

If you do nothing, you will receive no payment from the settlement, and your rights will be affected.

The Settlement provides two types of compensation:

Documented Loss Fund: You may claim reimbursement of up to $5,000 for documented losses, including compensation for up to 4 hours of lost time at $25 per hour.
Non-Documented Pour-Over Fund: After paying all documented claims, service awards, and legal fees, the remaining funds will be distributed equally among all class members who submit valid claims.

The Court in charge of this case still has to decide whether to approve the Settlement. Payments will be made if the Court approves the Settlement and after any appeals are resolved. Please be patient.

Your Legal Rights and Options in this Settlement

Action & Due Date	Explanation
SUBMIT A CLAIM Deadline: July 9, 2025	You must submit a claim to receive payment. You will be bound by the settlement. If you submit a valid claim and the Court approves the Settlement, you will receive a portion of the Net Settlement Fund.
EXCLUDE YOURSELF Deadline: June 24, 2025	You won't receive any benefits from the settlement. You won't be bound by the settlement. You keep your right to sue L&B Transport, LLC on your own about the same legal claims in this lawsuit.
OBJECT Deadline: June 24, 2025	Write to the Court about why you don't like the Settlement. You may file a written objection telling the Court why you object to the Settlement and think it should not be approved. Submitting an objection does not exclude you from the Settlement.
DO NOTHING No Deadline	Get no payment from the settlement. Give up rights to sue L&B Transport, LLC about the data incident claims. You will still be bound by the settlement and its "release" provisions.
ATTEND THE HEARING July 24, 2025 at 10:00 A.M.	Go to Court. The Court will hold a "Fairness Hearing" to consider the Settlement, the request for attorneys' fees and costs, and the Plaintiff's request for Service Awards. You may, but are not required to, speak at the Fairness Hearing about any objection you filed to the Settlement.
